Terms of Service

These Terms of Service ("Terms") govern your access to and use of the mobile and desktop applications offered by Mobeera ("Mobeera," "we," "us," or "our"), including WordPilot and PDF Max (each an "App," and together the "Apps").

By downloading, installing, or using any App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download or use the Apps.

These Terms are a legal agreement between you and Mobeera. They supplement, and are subject to, Apple's own terms applicable to your use of the Apps through the App Store.

Subject to your compliance with these Terms and Apple's then-current App Store terms, Mobeera grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Apps on Apple-branded products that you own or control, for your own personal or internal business use.

The Apps are licensed, not sold, to you. Mobeera and its licensors retain all right, title, and interest in and to the Apps, including all intellectual property rights. You receive only the license rights expressly stated in these Terms.

You may not copy (except as permitted by Apple's terms), modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Apps, nor rent, lease, lend, resell, sublicense, distribute, or otherwise transfer the Apps to any third party.

You acknowledge and agree that: (a) the Apps are licensed through Apple's App Store; (b) these Terms are between you and Mobeera, and Apple is not a party to these Terms; (c) Apple has no obligation or liability to furnish any maintenance or support services for the Apps; (d) Apple is not responsible for any claims, losses, liabilities, damages, costs, or expenses relating to the Apps or these Terms; and (e) Apple is a third-party beneficiary of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

You must comply with all applicable third-party terms and Apple's current App Store terms when using the Apps (for example, you may not use the Apps in any manner that violates Apple's media services terms and conditions).

Mobeera, not Apple, is responsible for the Apps and their content. If you have a question or claim regarding the Apps, you should direct it to Mobeera at the contact address in these Terms, not to Apple.

You agree to use the Apps only for lawful purposes and in a way that does not infringe the rights of others. You are solely responsible for the content you create, edit, import, or export using the Apps, and for ensuring you have the rights to do so.

You may not use the Apps to create, store, or distribute content that is unlawful, infringing, defamatory, or harmful. Mobeera does not review your documents in local workflows and is not responsible for the content you produce with the Apps.

Certain Apps include artificial intelligence features (such as Dr. Word review and WordPilot AI writing assistance). Currently available AI features run locally on your device and produce suggestions, analyses, and transformations based on your input.

If optional cloud AI features are introduced, they will be clearly labeled and used only when you choose them. Cloud AI features may send selected document content or related context to a cloud service to process your request.

AI outputs are provided for your assistance only. They may be incomplete, inaccurate, or unsuitable for your situation. You are responsible for reviewing and verifying all AI-generated content before relying on it, particularly in legal, financial, or professional documents. The Apps are not a substitute for professional legal, financial, or other advice.

Mobeera does not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated output.

Some features of the Apps may require an in-app purchase or subscription ("In-App Purchase"). In-App Purchases are processed and billed by Apple through the App Store, and are subject to Apple's then-current payment and subscription terms.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions, and turn off auto-renewal, in your Apple ID settings at any time.

Refunds for In-App Purchases are governed by Apple's policies. Please direct refund requests to Apple through your App Store account.

All In-App Purchases are non-transferable between Apple accounts except as permitted by Apple.

Mobeera may update, modify, or discontinue the Apps, or any feature within them, at any time and without notice. Updates may be delivered through the App Store, and some updates may be required to continue using the Apps.

We may revise these Terms from time to time. The most current version will always be posted at this page, with the "Last updated" date revised accordingly. Your continued use of the Apps after a change constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you should stop using the Apps.

The Apps may allow you to access or open files from, and save files to, third-party cloud storage providers of your choosing. Those services are governed by their own terms and policies, and Mobeera is not responsible for them.

The Apps may contain links to third-party websites or services that are not owned or controlled by Mobeera. Mobeera has no control over and assumes no responsibility for the content, terms, or practices of any third-party site or service.

You retain all rights in the documents and content you create, edit, or store using the Apps. In local workflows, your content is processed and stored locally on your device; Mobeera does not access, receive, or claim any rights to your content.

You are solely responsible for backing up your content. Mobeera is not liable for any loss of content resulting from device failure, app uninstallation, or other circumstances.

The Apps are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Mobeera disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Mobeera does not warrant that the Apps will operate uninterrupted, error-free, or secure, or that any defect will be corrected. You use the Apps at your own risk.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

To the maximum extent permitted by applicable law, in no event shall Mobeera be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of (or inability to use) the Apps, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if Mobeera has been advised of the possibility of such damages.

Mobeera's total aggregate liability for any claim arising out of or related to these Terms or the Apps shall not exceed the amount, if any, you paid to Mobeera (through Apple) for the App giving rise to the claim during the twelve months preceding the event giving rise to the liability, or fifty USD (US$50), whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Mobeera and its affiliates, officers, employees, and licensors from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Apps, your violation of these Terms, or your infringement of any third-party rights.

These Terms are effective until terminated. Mobeera may terminate your license to use the Apps at any time, for any reason, including if you breach these Terms.

Upon termination, your right to use the Apps ends. You may stop using the Apps and delete them from your device at any time. Sections of these Terms that by their nature should survive termination (including ownership, disclaimer, limitation of liability, indemnity, and governing law) will remain in effect.

These Terms and any dispute arising out of or related to them or the Apps will be governed by the laws of the jurisdiction in which you reside, or, if you reside outside the United States, by the laws applicable in your country of residence as permitted by Apple's App Store terms, without regard to conflict-of-law principles.

Before filing a claim, you agree to first contact Mobeera at the contact address below to attempt to resolve the dispute informally. Any claim you bring must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
